Copyright / DMCA Policy

Effective Date: August 19, 2026 · Last Updated: August 19, 2026

Overthink It ("Overthink It," "we," "us," or "our") respects the intellectual property rights of others and expects users of the platform to do the same.

This Copyright / DMCA Policy explains how Overthink It responds to copyright complaints involving content posted, uploaded, transmitted, or otherwise made available through the platform.

This Policy applies to Overthink It's website, applications, public forums, profiles, messaging features, shared cases, uploads, AI features, and other services through which user-generated content may be submitted or displayed.

This Policy supplements the Overthink It Terms of Service and Community Guidelines.

IMPORTANT STATUS NOTE: Overthink It has not yet designated a DMCA copyright agent and does not currently operate a dedicated copyright-complaint intake. The bracketed contact details in this policy are placeholders. Until a designated agent and a dedicated intake are established, the DMCA notice and counter-notification procedures described below are not operational. General copyright concerns may be reported through Overthink It's in-app reporting tool, and Overthink It intends to complete a formal DMCA process before relying on this Policy.

1. User Responsibility for Uploaded Content

Users are responsible for the content they upload, post, transmit, or otherwise make available through Overthink It.

Users must have a lawful basis or appropriate permission to use and share content they upload.

This may include:

  • Text
  • Photographs
  • Videos
  • Graphics
  • Screenshots
  • Images
  • Audio
  • Documents
  • Posts
  • Profile content
  • Conversation screenshots
  • Other copyrighted material

Users must not knowingly upload or distribute copyrighted material they do not have the right to use.

2. Copyright Ownership

Copyright generally belongs to the person or entity that owns the applicable rights in an original work.

Uploading copyrighted material to Overthink It does not automatically transfer ownership of that material to Overthink It.

Except for the rights granted to Overthink It under the Terms of Service, users retain whatever ownership rights they have in content they submit.

3. User License to Overthink It

When a user uploads or posts content to Overthink It, the user grants Overthink It the licenses necessary to host, store, reproduce, process, display, transmit, format, moderate, secure, and otherwise provide the requested service.

The precise scope of this license is governed by the Overthink It Terms of Service.

This license does not mean that Overthink It becomes the owner of the user's copyrighted work.

4. Copyright Infringement

Copyright infringement generally occurs when copyrighted material is used in a manner that violates the copyright owner's exclusive rights and no applicable legal exception or authorization applies.

Examples may include unauthorized:

  • Reproduction
  • Distribution
  • Public display
  • Public performance
  • Adaptation
  • Uploading
  • Commercial exploitation

Not every use of copyrighted material constitutes infringement.

Certain uses may be permitted by law, including potentially fair use in the United States.

Overthink It does not determine that every disputed use is automatically infringement.

5. DMCA Safe Harbor

For users and content located in the United States, Overthink It may seek the protections available to qualifying online service providers under the Digital Millennium Copyright Act ("DMCA"), including 17 U.S.C. § 512, where applicable.

Overthink It does not waive any rights, defenses, limitations, or protections available under applicable law.

Where applicable, Overthink It may respond to properly submitted copyright notices by removing or disabling access to allegedly infringing material.

6. Designated Copyright Agent

Copyright infringement notices should be sent to Overthink It's designated copyright agent.

  • Copyright Agent: [INSERT LEGAL NAME OR DESIGNATED AGENT]
  • Company: [INSERT LEGAL COMPANY NAME]
  • Email: [INSERT COPYRIGHT EMAIL ADDRESS]
  • Mailing Address: [INSERT BUSINESS ADDRESS]
  • Telephone: [INSERT TELEPHONE NUMBER, IF REQUIRED]

Do not publish this policy with placeholder information. Replace all bracketed fields before publishing.

If Overthink It designates a different copyright agent with the U.S. Copyright Office, the designated agent information should be kept current.

7. How to Submit a DMCA Copyright Complaint

If you believe copyrighted material has been posted on Overthink It without authorization and that the use is not otherwise permitted by law, you may submit a written copyright infringement notification.

A valid DMCA notification generally should contain the information required by applicable law.

To help Overthink It evaluate the complaint, include:

1. Identification of the copyrighted work

Identify the copyrighted work that you believe has been infringed.

If multiple works are involved, provide a representative list where permitted.

2. Identification of the allegedly infringing material

Provide enough information for Overthink It to locate the material.

Where available, include:

  • Post URL
  • Profile URL
  • Case URL
  • Message or content identifier
  • Screenshot
  • Username
  • Description of where the material appears

Do not submit unnecessary personal information.

3. Your contact information

Provide information sufficient for Overthink It to contact you, such as:

  • Full name
  • Email address
  • Mailing address
  • Telephone number

4. Good-faith statement

Include a statement substantially stating that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

5. Accuracy statement

Include a statement substantially stating that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner if you are submitting the notice on someone else's behalf.

6. Signature

Provide a physical or electronic signature of the copyright owner or an authorized representative.

8. Suggested DMCA Notice Format

You may use the following format:

Subject: DMCA Copyright Infringement Notice

Copyrighted work:

[Describe the copyrighted work]

Location of allegedly infringing material:

[Provide URL or other identifying information]

[Explain how the material allegedly infringes the copyrighted work]

Contact information:

I declare under penalty of perjury that the information in this notification is accurate and that I am authorized to act on behalf of the copyright owner.

Electronic signature:

[Name]

9. Incomplete Copyright Notices

If a copyright complaint does not contain sufficient information to evaluate the claim, Overthink It may request additional information.

An incomplete complaint may not qualify as a valid DMCA notification.

Overthink It may also be unable to act on a complaint if the allegedly infringing material cannot be located.

10. What Happens After a Valid Notice

After receiving a sufficiently complete copyright infringement notification, Overthink It may:

  • Review the complaint
  • Identify the relevant content
  • Remove or disable access to the content
  • Notify the affected user
  • Request additional information
  • Take other action permitted by applicable law

Overthink It does not guarantee that every reported item will be removed.

11. Notification to the User

Where appropriate, Overthink It may notify the user who uploaded or posted the allegedly infringing material.

The notification may include information about the complaint, including information necessary to allow the user to understand and respond to the claim.

Users should understand that submitting a copyright complaint does not necessarily guarantee that their identity will remain confidential.

12. Counter-Notification

If Overthink It removes or disables access to content because of a DMCA notice, the affected user may have the right to submit a DMCA counter-notification.

A counter-notification should generally include the information required by 17 U.S.C. § 512(g), including:

  • Identification of the material that was removed or disabled
  • The location where the material appeared before removal
  • A statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  • The user's name
  • Address
  • Telephone number
  • A statement consenting to the jurisdiction of the appropriate federal district court
  • A statement accepting service of process from the copyright complainant
  • The user's physical or electronic signature

Counter-notifications should be sent to:

Copyright Agent: [INSERT DESIGNATED AGENT]

Email: [INSERT COPYRIGHT EMAIL ADDRESS]

13. Counter-Notification Process

If Overthink It receives a valid counter-notification, we may forward it to the original copyright complainant.

If the copyright complainant does not notify Overthink It within the time period specified by applicable law that it has filed an appropriate court action concerning the allegedly infringing material, Overthink It may restore or cease disabling access to the material as required by applicable law.

Restoration is subject to applicable law and does not necessarily occur automatically.

14. Misrepresentation and Abuse of the DMCA Process

Do not submit a copyright complaint unless you have a reasonable basis for believing that infringement has occurred.

Knowingly submitting materially false or misleading information in a copyright complaint or counter-notification may result in legal consequences.

Depending on the circumstances, Overthink It may take action against users who abuse the copyright-reporting process.

This may include:

  • Removing the user's content
  • Restricting account functionality
  • Suspending an account
  • Terminating an account
  • Preserving relevant records
  • Responding to appropriate legal requests

15. Fair Use and Other Legal Exceptions

Overthink It recognizes that copyright law contains exceptions and limitations.

In the United States, this may include fair use under 17 U.S.C. § 107.

Potentially lawful uses may include certain:

  • Commentary
  • Criticism
  • News reporting
  • Teaching
  • Scholarship
  • Research
  • Parody

Whether a particular use qualifies as fair use depends on the specific circumstances.

Overthink It does not guarantee that a particular use qualifies as fair use.

Users should seek independent legal advice if they are uncertain about their rights.

16. Screenshots and Conversation Images

Overthink It allows certain features to process screenshots and images of conversations.

A screenshot may contain copyrighted material belonging to another person or platform.

The fact that a user can access or capture an image does not automatically mean that the user owns the copyright in everything shown in it.

Users should consider:

  • Whether they have permission to share the image
  • Whether the content contains another person's copyrighted work
  • Whether the intended use is legally permitted
  • Whether unnecessary identifying information should be removed

A screenshot may also contain private or personal information, which is addressed separately under Overthink It's Community Guidelines, Privacy Policy, and Safety & Reporting Policy.

17. User-Created Conversations

Users generally retain whatever rights they have in original text they create.

However, a conversation may contain contributions from multiple people.

A user should not assume that they have unrestricted rights to publicly redistribute another person's original writing simply because the conversation was sent to them.

Users should consider applicable copyright, privacy, confidentiality, and other legal rights before publicly distributing private conversations.

18. Profile Photos and Social-Media Content

Users should not assume that a publicly visible photograph or profile image is free to copy or redistribute.

Public availability does not necessarily eliminate copyright protection.

If you upload another person's photograph, artwork, profile image, or other copyrighted content, you are responsible for having the necessary rights or legal basis to do so.

19. Repeat Infringers

Where required by applicable law, Overthink It may maintain and reasonably implement a policy for terminating accounts of users who are repeat copyright infringers.

Overthink It may also take action against users who repeatedly upload material after receiving valid infringement notices.

Depending on the circumstances, enforcement may include:

  • Content removal
  • Feature restrictions
  • Temporary suspension
  • Permanent account termination

20. Circumvention of Copyright Enforcement

Users may not attempt to evade copyright enforcement by:

  • Re-uploading removed content
  • Creating replacement accounts
  • Slightly modifying infringing content solely to avoid detection
  • Splitting copyrighted material into multiple uploads
  • Reposting material after receiving a valid infringement notice

Overthink It may take additional enforcement action when users intentionally attempt to circumvent copyright restrictions.

21. Automated Copyright Systems

Overthink It may use automated systems, third-party services, or other technical measures to identify potentially problematic content.

Automated systems may make mistakes.

Detection by an automated system does not necessarily establish infringement.

Overthink It may provide appropriate review or appeal mechanisms depending on the feature and circumstances.

22. Third-Party Platforms

Content displayed through Overthink It may originate from or reference third-party platforms.

Overthink It does not necessarily control the copyright policies or enforcement decisions of third-party services.

Users remain responsible for complying with applicable rights when importing, uploading, copying, or redistributing third-party content.

23. Links to Third-Party Content

A user may post links to external websites where permitted by the Community Guidelines.

However, linking to material does not automatically make the underlying content lawful.

Overthink It may remove links that:

  • Facilitate copyright infringement
  • Circumvent legitimate access controls
  • Distribute pirated material
  • Violate applicable law
  • Otherwise violate the Terms of Service or Community Guidelines

24. Copyright Complaints Involving AI Features

Overthink It provides AI-powered features that may process user-submitted text and images.

Users must not intentionally use AI tools to generate or distribute content that infringes another person's copyright.

Examples may include intentionally generating:

  • Unauthorized copies of copyrighted works
  • Substantial reproductions of protected content
  • Copyrighted images without appropriate rights
  • Unauthorized adaptations where prohibited
  • Content designed specifically to circumvent copyright protections

AI-generated content is not automatically free of copyright restrictions.

Users are responsible for considering applicable rights before publishing AI-generated or AI-assisted content.

25. AI Analysis Does Not Transfer Copyright Ownership

Submitting copyrighted material to an Overthink It AI feature does not automatically transfer ownership of that material to Overthink It.

The rights associated with uploaded material remain subject to the rights of the original copyright owner and the applicable terms governing the user's relationship with Overthink It.

26. Removal Does Not Determine Legal Liability

If Overthink It removes content following a copyright complaint, that action does not necessarily mean that a court has determined the content infringed copyright.

Similarly, if Overthink It does not remove content, that does not necessarily mean that the content is legally non-infringing.

Platform moderation and legal determinations are separate matters.

27. Other Intellectual Property Rights

This Policy primarily addresses copyright.

Other intellectual property disputes, including:

  • Trademark infringement
  • Trademark impersonation
  • Patent disputes
  • Right of publicity
  • Trade secret issues
  • Other proprietary rights

may require a different process.

Users should not submit a DMCA notice for a dispute that is exclusively about a trademark, patent, or other non-copyright right.

Overthink It may provide separate reporting procedures where appropriate.

28. Privacy of Copyright Complaints

Copyright complaints may contain personal information.

Overthink It will handle complaint information according to its Privacy Policy and applicable law.

Users should provide only information reasonably necessary to establish and process the copyright claim.

Do not include passwords, authentication codes, financial credentials, or unrelated sensitive information.

29. Legal Requests

Overthink It may respond to valid legal processes relating to copyright disputes.

This may include:

  • Subpoenas
  • Court orders
  • Other legally valid requests

Overthink It may preserve or disclose information when required or permitted by applicable law.

30. Changes to This Policy

Overthink It may update this Copyright / DMCA Policy as:

  • Applicable law changes
  • Platform features change
  • Copyright procedures develop
  • Legal requirements change

Material changes may be communicated through appropriate means.

The current version will be made available through Overthink It.

31. Contact

Copyright complaints and counter-notifications should be directed to Overthink It's designated copyright agent:

  • Overthink It
  • Legal Company Name: [INSERT LEGAL ENTITY NAME]
  • Copyright Agent: [INSERT NAME OR DESIGNATED AGENT]
  • Email: [INSERT COPYRIGHT EMAIL]
  • Mailing Address: [INSERT BUSINESS ADDRESS]
  • Telephone: [INSERT TELEPHONE NUMBER, IF APPLICABLE]

Do not publish the policy until the designated-agent information has been completed and verified.

32. Final Copyright Principle

Overthink It is intended to provide a place for adults to discuss relationships, conversations, dating, friendships, and everyday situations.

Users should be able to share their own experiences without treating other people's creative work as automatically free to copy.

The basic rule is:

Only upload or share content you have the right or lawful basis to use.

If you believe your copyrighted work has been used improperly on Overthink It, use the copyright-reporting process described above rather than attempting to retaliate against the person who posted it.

This Policy includes bracketed placeholders for the designated copyright agent and contact details that must be completed and verified before publishing.
